You have not adequately explained that Laura Posner has failed, because having been handed two weeks to "adequately explain", there is no "she's failed" written in stone.

The 2 weeks is to object to the recommendation to dismiss the complaint. NWBO will, but almost certainly that goes nowhere,

After that NWBO will sometime in the future resubmit the complaint with better documentation on how the remaining sales actually were tied to closing prices on the asserted spoofing dates. Then Citadel et all will again file a motion to dismiss on the new complaint by NWBO. Then ....

If all that survives and the case goes on then starts months of arguments on how discovery would go. And then a year or so on that. Then the motions for summary judgement based on all the precious arguments but now with the defendants evidence now being allowed in. The idea of a trial in 2015 is a reach. And 2014 is comical.

I recall the board legal expert said a year ago that this case would go fast as that is how Fed courts work.
