I don't pay for PACER so I do not know the content of what was filed today. I doubt the Judge would have agreed to allow depositions to start tomorrow if they were going to dismiss the case today. Also notice that after the Dismiss/Fail there is an Opening Brief in Support. Without access to the actual documents IN MY OPINION someone saw Document 29 Dismiss/Fail and is making it look like there is nothing wrong.
