Only (XXXX) Can Approve of a dividend release'

I was under the impression, and as you mentioned previously, that as a REIT entity the IRS requires that 90% of monies needs to be distributed annually for tax purposes. Why isn’t this being followed? Why isn’t ‘XXXX’ being forced to comply? Am I missing something?
