I understand how 10b-5 lawsuits work. You essentially agree with my point, which is that a lawsuit at this time would be frivolous because there is simply not enough information to determine whether there has been a material misrepresentation, much to the chagrine of the short cabal, and their ambulance chaser buddies who often try to help them out.

Your point that the necessary information might be revealed in the future is valid. Or it might not.

I can’t see any reasonable chance that we file an NDA based on a false SAP premise and then get a deficiency letter or non-acceptance on that basis. AVXL’s FDA experts are not that clueless.
