I agree with you. my choice of the word "sloppy" was not very good or accurate. At the time they wrote the memo, apparently the case had not yet been overturned by a higher court. What I obviously meant to say was that they were cut off at the knees when the court later reversed the case they were depending on in their memo. I also think it was worse than just bad luck - they might have anticipated such a possibility as likely.
