It would depend if he disclosed any agreement he reached or not.

The scenario you describe (which has some issues that make the premise all but impossible) could be considered stock manipulation if it is undisclosed and coordinated.

1) Do I own stock?
Answer: No. I don’t invest in penny stocks.
2) Why am I here?
