There is a difference between a wide berth and breaking the law by moving beyond that wide berth and creating a need for enforcement action. Cohen believes the market makers named broke the law, have a strong case to prove it and that an enforcement action is warranted. DOJ has been doing their own investigation of short side hedge funds to see if laws were broken and enforcement action is warranted. That is different than a company operating within a wide berth that is warned about in writing and protected in the forward looking statements disclaimers. It’s well past time to understand this for anyone claiming to be long. Best wishes.
