We need to get past the Sept 15 year date. That will end any hopes non releasers or employees had of suing. The FDIC has stated they can not close the receivership while there is possible pending litigation.
So I say funds could be disbursed after that date. The insts knew they had to wait for that date to pass. So funds could flow to escrows without those threats of litigation if funds had been disbursed while we were still within that 15 yr window.
I contend nothing can happen until then. This is why the UWs and hedgies have been sitting back.
So as of Sept Oct we should start to see activity for escrows. Just my opinion but it makes sense. Why else did they say there could be no release of any funds while there was possible pending litigation?
I don't think Libor is the holdup.
