"modeled on". ?? Having read the excellent complaint filed on behalf of NWBO, it certainly appears to have factual plausiblity. The reasonable inference standard easily supports that the market makers are liable for the misconduct so succinctly pleaded by NWBO. Unless some unusual measure or standard is applied or some other issues are present but unknown to me, it is highly unlikely that Citadel's motion to dismiss would be granted.
