how much empirical data is needed to be filed with a patent application in order to be granted a patent of this sort?


Most such patents, like many we have seen from Anavex and discussed this everytime, have only prophetic examples.

One good reason for this is that to patent something it must not previously have been publicly disclosed, which a clinical trial to obtain empirical data would. Hence, patents for utility and composition of matter in medicine are filed with thought up examples of potential utility.
