Am injunction would make them settle (though I could not say how likely it is that the injunctions would remain during an appeal), but alone a sizable risk of stopping production (and losing clients) would make them settle. However, Netlist would not give up these 300 Mio and of course the terms of a settlement would be subject of the negotiations. If Gilstrap orders injunctions it could get really hot here. Image of they would drop the 912 IPR as part of a settlement…..obviously a settlement would also include future royalties and Netlist would point to the value determined by the jury (!) Netlist certainly would have a margin to lower royalties (compared to the jury‘s award). Anyway, it is becoming more and more interesting. Maybe Netlist does not need to fight anymore for years one by one, step by step. This is the right approach and strategy obviously. However this does not exclude that once the chain of dominions start falling quickly…..
