"The SEC has proven that Nutra Pharma Corp. offered common stock without registering to do so or filing necessary forms, and that the CEO of the homeopathic remedy maker failed to report acquisitions of the stock as required, a federal court in New York ruled.

Summary judgment is appropriate on those claims, Judge Joanna Seybert said Wednesday for the US District Court for the Eastern District of New York.

But the Security and Exchange Commission’s claim that the executive, Erik Deitsch, aided and abetted securities law violations must be tried by a jury, she said.

"In a litigation matter, the United States District Court for the Eastern District of New York granted the SEC summary judgment on various claims against Nutra Pharma Corporation and its CEO, Rik Deitsch. In its complaint, the SEC alleged that, among other things, the company and Deitsch had issued or posted a series of press releases that materially misled investors and had engaged in manipulative trading to try to stabilize and increase Nutra Pharma’s stock price and create the appearance of active trading."

If the SEC disgorges any money or collects any fines from Deitsch - then this could fall under the Fair Fund Plan.
