There is an expectation for a National Lithium Law. Although it is the Ministry of Mining that presides over the Lithium Commission, there are more “powerful” organizations, such as CORFO, on which the associated resources depend, since practically the most important and relevant part of the Salar de Atacama is owned by the State of Chile through the Production Development Corporation (ie CORFO), which owns 32,768 mining properties that occupy an area of 1,638 km2 (55% of the total area), which covers the most relevant and primordial part of the core of the Salar de Atacama, where the best reserves and concentrations of lithium and potassium are located. 819 km2 are leased to SQM for a term that ends on December 31, 2030, and 167 km2 are temporarily transferred to the Chilean Lithium Society, whose term expires once they have extracted lithium salts equivalent to a total of 200,000 tonnes of metallic lithium.

The Chilean Nuclear Energy Commission (CChEN), created in 1965 through Law 16.319, designated lithium as a material of nuclear interest. And article 8 of said law states that extracted lithium and derived concentrates or compounds may not be subject to any legal act unless it is executed by CChEN, with it or with its prior authorization. Thus, the Ministry of Mining is relegated to adhere, once again, to those decisions. In fact, it was expected that Codelco could develop a Chilean lithium exploitation industry due to its experience, as it said: but no, the ministry could do nothing and is simply waiting for the law that defines who will exploit lithium and how that exploitation will be carried out.
