I agree. GSK's lawyers wrote an outstanding Brief. But I think the granting of Cert. went from a coin-flip to it should be Certiorari denied. The reason is that there are Remand proceedings already scheduled with the District Court. The SCOTUS generally does not hear cases that have proverbial dangling participles, which this Remand proceeding appears to be.
