If they purposely let this go to the expert market some eyebrows will go up and people would be looking in their direction. Not only that they would be admitting guilt and that would not fare too well for them. Going by that logic I think they would be compelled to file or face criminal charges. Do not think they would be up for that. And do not think XU (even if he is gone) would be exempt from criminal charges as he very well might if he has done something wrong.

Personally I would think the criminal charges may be looking at XU verses new management (if it comes down to that).

Something is definitely amiss here!
