Are there 2 versions of proposal #9?

9. Proposals 3, 4, 5, 6, 7, 8 and 9 contemplate the addition of seven new directors and the removal of one incumbent director. If seven new directors are added to the Board of Directors of the Company but the incumbent director is not removed, then the Board of Directors of the Company would have 16 members, exceeding the 15-member limit prescribed in the Company’s organizational documents. None of Proposals 3, 4, 5, 6, 7, 8, or 9 is conditioned upon the passage of Proposal 1. As a result, Proposal 9, to elect Sarissa’s seventh nominee, would be legally invalid because no additional seats would be available at the time that proposal is presented. The default result would be that Diane Sullivan will not be validly put before the General Meeting for appointment since the proposal to elect her would be in breach of the Company’s organizational documents.
