Whoever is offering you guidance is mistaken.

A motion to dismiss is extremely routine and does not involve any factual analysis of whether what has been alleged is true or not.

A motion to dismiss does not evaluate the facts of a case. This is a widely known universal truth in law and easily proven and this is not a controversial statement.

The comment regarding injunctive relief also doesn’t logically follow - being able to pay for the consequences of a bad act would not provide a defense to why the bad act should be allowed to go on without recourse. Recall that the bad act in question is not legal.

When the act in question is not legal (spoofing), it wouldn’t make sense to be allowed to continue doing your bad act just because you can pay for it.

Remember, it’s not a legal act so ordering Defendants to stop it will not cause the Defendants any harm. Courts are more cautious when an injunction against legal behavior is sought. There is an easy logic to this one.
