Ralphey, yes I am aware of that "Dang" Class Action filed in 2021. I have not followed its progress, but I remember reviewing the initial Complaint, and finding many of the allegations to be defective.

For instance, a large portion of their allegations are based upon supposed assurances that occurred after March 30, 2020. I don't see how any of that survives a Motion to Dismiss, as I don't see how a court would accept reasonable reliance upon the success of appeals.

The strength of any fraud case against Amarin lies in the omissions of material fact on the strength of the patents prior to March 30, 2020. The ANDA litigation was universally perceived as almost a nuisance case, when in fact, the risks were far more dire than disclosed.

PACER Monitor reveals that the case is moving at a snail's pace with the parties litigating all of 2022 over consolidation and appointment of lead counsel. A Motion to Dismiss has not even been filed yet.
