The year of Truth, Justice, and Accountability has begun a little early.

Earlier this week, I formally served the Board of Directors with the linked Demand Letter and Exhibits. Before the end of March, 2023, I will be filing a derivative legal malpractice suit on behalf of Amarin against Covington & Burling/Joseph Kennedy, seeking damages of not less than $4 Billion.

Because it is a derivative action, any potential damages recovery goes to the Company, not individual shareholders for losses, as the duty owed by the attorneys is to the Company, not its shareholders. Hence, the suit can only be brought derivatively.

My nearly three year investigation since 3-30-2020 confirms that the attorneys owed various duties to the Company; the attorneys breached those duties as detailed in my Demand Letter; and those breaches were a substantial contributing factor causing Amarin's damages of not less than the $4 Billion. The trial was winnable and/or the case should have been settled given the devastating risks, yet none of that occurred, resulting in $1.20 today. One of the ancillary benefits of the Rule 60 effort, is that it developed many of the proofs. A cause action for legal malpractice is stated.
