I do realize that and my answer was to a future scenario where the criminal justice system became involved and was addressing the appropriateness of a no-knock warrant in that scenario.

Right now, to the best of our knowledge, there is no state or federal criminal investigation but it is important to bear in mind that the FBI and other agencies often do not comment on investigations until much later in the process so all anyone could see would be a civil suit. I think it is unlikely that this has yet become a criminal investigation (proceeding on its own track) but that does not mean it is impossible and it is now much more likely than before.
