From what I see and hear, virtually everyone in the investment industry thinks Shells are garbage, and anyone involved with sale, purchase, acquisition, hijacking or any other form of acquisition is a degenerate,just waiting. and plotting g to screw everybody. OK! It's not quite that bad but close. It is safe to say that every regulatory body would breath easier if Shells never existed.
Personal opinion: Within 2 years, there will be a separate entity established with its own set of rules, including more protections extending into the future, bright-line tests and clarification of indemnity, escrow and buyback clauses; time constraints and restrictions on debt accumulation, yada, yada, yada; In other words, legitimize the handling of Shells.
