When I saw the list of defendants, at first I was a little dismayed that I did not see the name of AF among the defendants. Then I realized that he was defaming and slandering but not actually spoofing or naked short selling which is what this cause of action is for. Then on thinking a little further, I started to wonder if he could be part of a conspiracy to spoof etc. and sued for that. Or is conspiracy on a criminal notion and does not work in civil law suits. In any case this might be hard to prove and he does not have deep pockets (except for insurance) to make the effort worthwhile. Anyone know more than me about my musings?
