Please, that was a civil case, not criminal. Moreover, case went very poorly for FTC after they refused Judge's suggestion of arbitrated settlement. In other words, Judge signaled he didn't think case warranted a trial, and FTC kept pushing. Just dumb lawyering on their part. Then the whole basis of their original complaint was rendered moot by an unrelated SCOTUS decision. So FTC had to redraft the complaint under a different authority citing different statues. In interim, Judge permitted JB to resume business. JB ending up settling case with FTC under far better terms than would have been case had FTC been smart and followed Judge's initial suggestion to enter arbitration rather than trial. Stars were aligned with JB on that one. Most fair far worse with FTC.
