Yeah, well Barry can assert whatever he wants. A judge can agree with him that Eddie "stole" his company and rule that Eddie is liable. It then comes down to damages and Barry is unlikely to prove that Eddie deprived him of anything or destroyed anything because that "thing" didn't exist other having a name.
If you stole my lunchbox and I file a lawsuit saying that there was a tuna sandwich inside that was worth $50 million I might be successful proving that you deprived me of my lunch, but I don't think a judge would award me very much for the loss of my sandwich. The dill pickle and bag of Fritos, on the other hand, might be worth a couple of grand.
