In fact, didn't Singer win his highly publicized case, in which he defended his client's improved, more convenient version of it's drug, which had come off patent as nonobvious? So apparently, better formulations which foster better compliance without compromising effectiveness is encouraged and legally protected. I don't see the self emulsifying version being held up by red tape.
