Pdude, You are not wrong. That is why the case against Hikma was dismissed. When it comes to Health Net it's a different story. The fact that they require a PA proves that they have knowledge that the prescription is for CVD. Offering a financial incentive for the generic to be substituted is the overt act. To the best of my knowledge this is the first time an insurance provider has been sued for inducement. I am not a lawyer but the logic of the suit holds.(my opinion) The argument that Health Net isn't responsible for inducement while providing financial incentive to convince a patient to commit direct infringment doesn't hold up. When you pay someone to commit a crime you are as guilty as the criminal.
