Plaintiffs Borgese and Privitera brought a single cause of action, for tortious interference
with contract, against Mr. Burba as the fifth cause of action in the Complaint. Additionally, the
corporate plaintiff they control, North American Lithium, Inc. brought a sixth cause of action
claiming breach of contract against Mr. Burba. On June 2 2022, the Court held that Plaintiffs had
failed to state a claim as to their fifth and sixth causes of action and dismissed Plaintiffs claims
against Mr. Burba in this action in their entirety. (ECF No. 30).
