Amid all the chaos surrounding the controversy of the REDUCE-IT trial, there is a silver lining. The counter legal claims by generics and Health-Net that prior art made REDUCE-IT patents obvious are far from reality. If Persons of “Extraordinary” Skills in the Art are still not convinced today, then how can Persons of “Ordinary” skills in the Art (POSA’s) make the “Obviousness” claims from prior art?
Answer: They CANNOT! Circular Logic is in play here. Our critics and enemies can't have it both ways.
