It was an administrative technicality. The current Supreme court disagreed with longstanding practice within the American administrative system. Agree or disagree, like it or not, it's an interesting situation with continuing repercussions for business and consumers.
The thing is, it didn't mean that the SEC investigations were faulty, or wrong, or anything that folks like to claim. It just meant that the process used to hire the judges was no longer seen as acceptable.
You do know that many of those Judges were re-hired under the corrected process don't you.
BIEL violated the law, they got caught, they got penalized. That is the end of the story. Except the part where they still haven't paid there fine.
