Correct on both counts. BMY's CEO was heavily criticized for not doing the due diligence on Erbitux prior to signing the huge deal with IMCL a few months before the RTF.

The FDA has three options at the 45-60 day deadline for acceptance of the BLA:

Accept with Priority Review
Accept with Standard Review
RTF Notice (no acceptance)
