Can one reasonably conclude that since they are noting this information in their current 10K it suggests that they are still pursuing these patents?

They may be or may not be encroaching on a competitors technology or vice versa resulting in a challenge for exclusivity and we know this process can drag on for some time as we are obviously dealing in a highly competitive space but such technology if patented could be very valuable.

One of the issues which came up with the first device/version is which Dent openly discussed recently was that practices felt more comfortable working without the PAH hardware thus this prompted them release their second version last year, but they did not cease using the device due any infringement that we know of, now my further question is whether the second version of the technology is one that they are also pursuing.

They have in a past 10K filing referenced the term provisional which has since been classified as pending in their most recent 10K's.

It's hard to believe that Dent and co. would choose to leave this in a 10K if they somehow lost the rights to the technology, so we can debate what the term "pending" means in this case and that could mean one or many things but for now it is in their recent filing and so will remain optimistic that said technology is still relevant and viable toward their overall business plan.
