What's the diff between dismissing the case against Hikma and in not being a final ruling? Did you read the CC transcript where KM says:

While we are disappointed in the ruling on a motion Hikma’s motion dismissed, we recognize that this is an evolving area of the law. Amarin intends to appeal of the district court decision. Amarin believes that its patents are being infringed upon and will continue to fight to protect the company's intellectual property.

You say AMRN can't appeal dismissal because it's not a final ruling - something doesn't add up - one of us does not understand what actually happened here.

Can someone else chime in and explain if Hikma is off the hook or not? Sleven and I frequently disagree on what a legal filing actually means, and we've both made mistakes in interpreting what happened before - that's why I'm asking for another opinion - preferably marjac if he sees this.
