If they have a commercial discovery on their hands and want to go private, a buy back at fair value is how it should happen.
They would need to do a proxy though, and if they had the majority they could make it happen. Now if were dealing with a company who wants to conceal a discovery and let stock tank to .01-.02 levels and then announce a buy back to go private is criminal. If MJ2 eventually ends up having oil or is apart of production oil system with other wells then Zion would get a class action lawsuit from investors. IMO, if theres a discovery I don’t think they would take such a path.
