Rightly, or wrongly, I view the DEM appeal to be secondary to the court ruling on whether the new law applies or not. Really can’t see the DEM investing any time until this is resolved. If the new law applies, then DEM has nothing to review - why would they approve something that is in conflict with the law. If the law doesn’t apply, game on with DEM rendering a decision.
