In context...GM was saying he would fight if the Merging Entity would accept the Indemnities.
It appears they did not want to go the Indemnity Route...so GM apparently has decided not to fight.
Also, remember that GS responded AFTER this with his "Evidentiary Objections" ...so it's my opinion that GM chose not to respond and not show up today....and let's not forget that scores of Investors have practically pleaded with GM to settle and let it go.
So maybe he chose to take that advice and win with the Merger?
