You are correct that the former unit holders of the TRUST will receive
the bulk of the damages (they were the ones injured from Bass).
The legal fees the TRUST paid for them will have to be paid back (as the
trust does not have the responsibility to sue in their name). surely
part of a verdict (assuming Bass is found guilty - logical conclusion)
would be paying for the legal representation.
My point all along was that IV's claim is for the damages to their
business and ability to conduct and grow it. I estimated (and still
believe) that to be > $3 per unit before legal costs and damages.
One of the key things over here is that Bass blew up financing deals of
banks that have conducted their own due diligance to begin with and
where the money was designated for specific things.
