no. any owner of the stock will get their divvy. the company will be responsible for the number of o/s shares while the shorters for the rest. in your example, if there are 4 billion shares short and the divvy is .01 per share, the shorters will be responsible for a cash payment to DBMM's T/A for $40 million. they can get out of this payment by covering prior to a specific date. their choice, but if they pay cash to the T/A they are still short the stock AFTER the divvy payout. so the synthetic owners will still get their divvy.
