If you refer to § 11.42 also known as the "one year rule". yes they are in violation of that rule for the simple reason that they stated that they will submit results in coordination with the journal and the journal is late due to Covid, so Covid can not be the excuse. The NIH opinion on the pending journals:

In general, pending publication would not be considered good cause for an extension.



Anyway, you said you dont want to discuss legal issues. Thats up to you, I am fine discussing it for its a vital subject for shorts and longs
