Capt. Beer is the go-to guy on Panel preferences. I believe he concluded from his analysis that Judges Newman, Moore, O'Malley would be most ideal. I believe that we can win with any Panel, including a Panel where one or more of the Judges sat on the previous Amarin appeal. The issues presented here are very different than the issues presented in Amarin's appeal. Hence "inadequate representation" for purposes Rule 24 Intervention.
