Good morning ENZC shareholders. This case should be dismissed. Mergenthaler has filed a case with a "fatal flaw" which means it should be dismissed because it legally doesn't make any sense. In fact, if you read the brief one of the best statements from ENZC:

"Plaintiff’s Cross-Motion Should Be Denied.
Plaintiff’s cross-motion requests that the Court set an indemnity bond, without citing any legal authority to establish a basis for this request. Moreover, the cross-motion itself conclusively establishes the basis for ENZC’s motion to dismiss Plaintiff’s Complaint, which is that Plaintiff
has not filed the requisite indemnity bond. Plaintiff’s cross-motion is procedurally improper, lacks any legal or justifiable basis, and provides only further reason to dismiss this action."

That's right! Mergenthaler has actually given the reason in his own words why the case should be dismissed! There's more. It's a great read. Charles did well in hiring Antranig Garibian to represent ENZC. They don't mess around.

It's one thing to post and say a company has "issues". It's another thing to do the DD and represent the facts. As my personal attorney likes to say, "Don't confuse issues with facts". This case is a nothing burger in my opinion. Have a great day everyone!
