13. Energy Supreme Releases Walther. Pursuant to paragraph 4 of the
Agreement, the Federal Court Judgment against the Federal Court Judgment Debtors
was not purchased by the Plaintiff,however, pursuant to paragraph 14 of the Agreement,
Energy Supreme specifically released Marc Walther of any claims, including all claims related to the Federal Court Judgment.

Explained pretty clearly why Walther was included in the ACRA lawsuit.
