I think we can assume this is exactly what happened. A denial of the en banc is that last entry in the case.
"If the panel drafts a new opinion for publication, however, that draft would likely again circulate to the full court before issuance, and the full court may issue an order acting in some way on the en banc petition simultaneously with the issuance of a new panel order."
Again I think this is what happened.
My question would be this. Based on what I am reading it sounds like the first en banc denial came from the entire court after being aware of the content of the second panel ruling.
Do you read it the same way?
