ggwpq, Normally you would be correct.(I think) Our FDA exclusivity is not being enforced. Hikma is selling gv for the CVD indication. FDA doesn't care. That is why we initiated the infringment suit. One of the major differences between the two cases is theoretical infringment verses actual infringment. In Nevada it was a Hatch Waxman suit.(theoretical infringment) In Delaware it's about active infringment. I think the case is solid, especially for a jury.
