Panel members are identified to the public on the day of oral argument. The random assignment of all judges will be known to Chief Judge Moore a week or more prior to the day of argument; the remaining judges will be notified of their respective individual assignments that early also to enable their chambers to prepare memoranda informing that chamber what the case is about(the issue(s) on appeal, what the lower tribunal said about those issues, and what the parties’ positions is/are with respect to those issues(s). Those memoranda are subsequently sent to the other panel members.
