I feel EIE needs to clarify/acknowledge that the patent "rejection" based on p/a Mori was a "NFR"= non final rejection (which is a big nothing burger to use his lingo) and that the patent was ultimately approved. As Capt. says... a bump on the pathway to issuing and protecting the IP, which was later successfully acknowledged by the US PTO... thanks to those pointing out this process. As long as EIE is using term "Reject" when it's an NFR, he's being misleading or has misled himself to support his thinking that these recent Class action suits have merit... wishful thinking perhaps, as we all want to be made whole from our losses one way or another.
