I have not read the 2015 cited case. But think, folks. How did H and R manage to achieve a finding in Nevada that A's 6 patents were invalid in light of the prior art even though a finding of inducement of infringement was made simultaneously? Was the defense made in a separate case which was later consolidated with the infringement action?
Proof of the belief is necessary, rather than mere assertion of a belief?
