NS, That’s the way I read it too. Based on the following link, I believe an invalidity challenge of ReduceIt patents could be part of the current infringement litigation. The infringement case will spillover into the ANDA challenge period. I believe the CVD patents exclusivity period, prior to any ability for ANDA/invalidity challenge, is due to expire Dec, 13 2022. If I’m reading this correctly. I’m not sure how long it will take after filing an ANDA to invalidate CVD patents. Hopefully others with more knowledge in this space will share their thoughts.
