"Before patent issued they intended to announce trial success.
Now the patent application record containing trial result evidence to comply with 35 USC 101 IS their announcement. Just a reminder, 35 USC 101 requires any patented subject matter to be new AND USEFUL. A failed trial would not allow the subject matter to be patented since it would not be useful. Therefore, the attorneys clearly submitted successful trial results to the USPTO to get the claims patented. The published application IS the announcement of a successful trial."
