It is not just rejected patents where this applied Anders.
Say you invented the carbonator and own the patent and your claims are board so the first independent claim is for a device the oxygenates fuels prior to combustion. You make think you are in the catbird seat but then along comes these other inventors filing patents with improvements to your carbonator that you had not thought of and that do not appear in your claims. One inventor comes up with a dual-barrel carbonator. Another inventor comes up with a way to super charge the oxygenation, make the process more effective by enabling the fuel to absorb more oxygen faster . . . and so on and so on. What this means is anyone that wants to manufacture and sell a dual-barrel carbonator including you would have to license it no just from you, but from the other inventor. Most patents are actually improvements on existing inventions.
. . . so for DCVAX and NWBO if another inventor comes up with an improvement to the method for producing cancer antigen sensitized dendritic cells that significantly improved the effectiveness of the treatment then NWBO might need to pay this other inventor if they wanted to use it . . . or worse yet this other inventor could refuse to license it to NWBO and then they would be prohibited from using the enhanced method.
