Update on the Rule 60/Rule 24 Appeal:

The Order denying the Appendix Motion just came over the wire. At first I was worried, but the Order parrots my Objection to the Defendants, namely that under the Federal Circuit's Rules, only the documents cited in the Briefs are to be included in the Appendix. This is a good thing, as the Court has provided clear guidance, and we cannot be compelled to engage in the unduly burdensome task of reproducing the entire Singer Appendix from the first Appeal.

Our new due date for the Brief is September 27, 2021.
Opposition Brief due on November 8, 2021.
Reply Brief due on November 29, 2021.


The 70 page Brief has been completed but for the Appendix page insertions. The Brief is currently being reviewed internally. Because the Brief is basically done, I may file much earlier than September 27. If I do so, the briefing dates move up, as the Opposition is due 40 days from the Opening Brief, and the Reply is due 21 days from the Opposition Brief
